Terms of Use

1. Agreement

These terms are an agreement between you and Axxy Intelligence Inc., a British Columbia company ("Axxy", "we", "us"). They cover the Axxy app and axxy.app (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Who can use Axxy

You must be at least 18 years old to use Axxy. Where the age of majority is higher than 18, you also need a parent or guardian to agree to these terms for you. You may not use the Service if the law where you live forbids it.

3. Your account

You sign in with a code we send to your email. Keep access to that email secure, because anyone who can read it can sign in as you. Give us an email address you control. Each account is for one person. Tell us at if you think someone else has used your account.

4. The Service and the limits of AI feedback

Axxy listens to you speak English, analyses your pronunciation and coaches you with an AI coach. Please keep in mind:

• Feedback can be wrong. Our engine and AI models are automated and sometimes mishear you or give inaccurate advice. Use your own judgement.
• It's for learning only. Axxy is not speech therapy, medical advice or a professional assessment. If you have a speech, hearing or voice condition, talk to a qualified professional.
• No guaranteed results. We can't promise any change in your accent, an exam score or a job outcome.
• The Service changes. We regularly add, change and remove features and lessons. Some features may be marked as early or experimental. We try to keep Axxy available but can't promise it will always work without interruption.

5. Your recordings and content

You own your recordings and anything you type into Axxy. To run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and analyse that content. The licence covers providing the Service to you and, as the Privacy Policy describes, improving Axxy with de-identified copies. It ends when the content is deleted. Switching off "Help improve Axxy" in Settings ends the improvement use for new recordings.

Record only your own voice. Don't record other people unless they have agreed.

6. Acceptable use

When using Axxy, you agree not to:

• break the law or infringe anyone's rights;
• upload other people's voices without their permission, or content that is abusive or unlawful;
• try to access other users' accounts or data, or our systems beyond the app;
• copy, reverse engineer or take apart the app or our engine, except where the law allows it;
• use bots or scripts to access the Service, or overload it;
• use the Service or its output to build a competing product, or to train other AI models;
• resell or share access to your account.

7. Subscriptions and purchases

This section applies once paid plans launch. Paid plans are sold through the Apple App Store, and Apple's terms apply to the payment.

• Prices are shown in the app before you buy.
• Renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can cancel in your Apple account settings. Deleting the app or your Axxy account does not cancel a subscription.
• Free trials become paid subscriptions when they end unless you cancel before then.
• Refunds are handled by Apple under its policies.
• Price changes are announced in advance, and you can cancel before they take effect.

8. Our property

The app, our engine, lessons, written and spoken content, the axxy character, our name and logo all belong to Axxy or to our licensors. We give you a personal, non-transferable, revocable licence to use the Service for your own learning, under these terms. If you send us feedback or ideas, we may use them without owing you anything.

9. Ending your use

You can stop using Axxy at any time and delete your account in Settings. We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or the Service. Where we reasonably can, we will warn you first. Sections 5 (as to content already used), 8, 10, 11 and 12 continue to apply after your account ends.

10. Disclaimers

To the extent the law allows, we provide the Service "as is" and "as available". We make no promises about the Service beyond those in these terms, including that it is error-free or fit for a particular purpose. Some places don't allow these exclusions, so some may not apply to you.

11. Limitation of liability

To the extent the law allows:

• we are not liable for indirect or consequential losses, such as lost profits, lost opportunities or lost data;
• our total liability to you for all claims about the Service is limited to the greater of what you paid us in the 12 months before the claim and CAD $100.

Nothing in these terms limits liability that the law does not allow us to limit, such as for fraud or for death or personal injury caused by negligence. Nothing in these terms affects the rights you have as a consumer under the law where you live.

12. Governing law and disputes

The laws of British Columbia and the federal laws of Canada that apply there govern these terms. Disputes go to the courts of British Columbia. If you are a consumer in another country, you also keep the protection of your local law and may be able to bring claims in your local courts. Before going to court, please write to us so we can try to resolve the issue informally.

13. Apple

If you downloaded Axxy from the Apple App Store:

• These terms are between you and Axxy, not Apple. Axxy, not Apple, is responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app.
• Apple is not responsible for any claims about the app, including product liability claims, claims that it fails to meet legal requirements, consumer protection or privacy claims, or intellectual property claims.
• You confirm that you are not in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Changes to these terms

We may update these terms as the Service changes. We will post the new version here with a new effective date. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using Axxy after that, you accept the new terms. If you don't accept them, you can delete your account.
